1. Overview

Welcome to Quartz Epoxy Pro LLC (“Quartz Epoxy,” “Company,” “we,” “our,” or “us”).

These Terms and Conditions (“Terms”) govern your access to and use of https://quartzepoxy.com (the “Site”) and all purchases made through the Site, by phone, or through Shopify-powered checkout.

By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase our products.

2. Eligibility and Account Responsibility

You must be at least 18 years old to purchase products from this Site.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and all activities conducted under your account.

3. Products, Descriptions, and Pricing

All prices are listed in U.S. dollars and are subject to change without notice.

We reserve the right to correct pricing errors, modify product offerings, or discontinue products at any time without liability.

Product images, colors, textures, and descriptions are provided for reference only. Actual results may vary based on surface preparation, batch variation, lighting, application method, environmental conditions, and installer skill.

4. Orders and Payment 

By placing an order through our Shopify checkout, you represent and agree that:

  • All billing, shipping, and contact information is accurate

  • You are authorized to use the selected payment method

  • You authorize Shopify and its payment processors to charge the full order amount, including taxes, shipping, and applicable fees

We reserve the right to refuse or cancel any order due to suspected fraud, pricing errors, or inventory issues.

5. Shipping and Delivery

Shipping timelines shown at checkout are estimates only.

Quartz Epoxy LLC is not responsible for delays caused by carriers, weather, labor disruptions, or circumstances beyond our control.

Once an order is marked “Delivered” by the carrier, responsibility transfers to the customer. We are not liable for lost or stolen packages after confirmed delivery.

6. Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are governed by our Return and Refund Policy below. All approvals are at the sole discretion of Quartz Epoxy Pro LLC.

7. Limited Warranty (Direct Purchases Only)

7.1 Warranty Coverage

Quartz Epoxy LLC provides a limited warranty for products purchased directly from quartzepoxy.com or directly from Quartz Epoxy LLC.

We warrant that our products will be free from manufacturing defects in materials at the time of shipment for 30 days from the delivery date.

This warranty applies only to:

  • Products used within stated shelf-life guidelines

  • Products properly stored prior to use

  • Manufacturing defects only

7.2 Warranty Exclusions

This limited warranty does NOT cover:

  • Improper surface preparation

  • Improper mixing ratios or application

  • Installer or workmanship errors

  • Failure to follow Technical Data Sheets (TDS), Safety Data Sheets (SDS/MSDS), or written instructions

  • Color variation, gloss variation, or aesthetic outcomes

  • Normal wear and tear

  • Moisture vapor transmission, hydrostatic pressure, UV exposure, chemicals, impact, or environmental conditions

  • Labor costs, removal costs, reinstallation costs, or loss of use

7.3 Distributor & Third-Party Purchases — NO WARRANTY

Products purchased through distributors, resellers, installers, dealers, or third-party marketplaces are NOT covered by any Quartz Epoxy LLC warranty.

All warranty claims for such purchases must be handled directly with the seller from whom the product was purchased. Quartz Epoxy LLC assumes no liability for products not purchased directly from us.

7.4 Warranty Claim Process

To submit a warranty claim for eligible purchases, contact:

Include:

  • Order number

  • Proof of purchase

  • Clear photos of the alleged defect

  • Batch or lot numbers (if applicable)

If a valid manufacturing defect is confirmed, Quartz Epoxy LLC’s sole obligation will be, at our discretion, replacement of the defective product or refund of the original purchase price.

8. Disclaimer of Warranties

Except as expressly stated above, ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

Quartz Epoxy LLC disclaims all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

Installer and end user assume all responsibility for determining product suitability.

9. Limitation of Liability

To the fullest extent permitted by law, Quartz Epoxy LLC shall not be liable for:

  • Indirect, incidental, special, or consequential damages

  • Loss of profits, revenue, or business interruption

  • Installation or labor-related costs

Our total liability shall never exceed the amount paid for the product giving rise to the claim.

10. Installer and Contractor Indemnification

If you are a contractor, installer, reseller, or other professional applying or reselling Quartz Epoxy LLC products (“Installer”), you acknowledge and agree that:

  • You are solely responsible for evaluating product suitability for each project

  • You are solely responsible for surface preparation, installation methods, jobsite conditions, safety compliance, and workmanship

  • You represent that you are properly trained, licensed, insured, and qualified to install epoxy and coating systems

You agree to defend, indemnify, and hold harmless Quartz Epoxy LLC, its owners, officers, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Improper installation or application

  • Failure to follow TDS, SDS/MSDS, or written instructions

  • Property damage, personal injury, or economic loss

  • Claims made by your customers, clients, or third parties

  • Misrepresentation of product performance, warranties, or coverage

This indemnification obligation survives delivery of products and completion of installation.

11. Intellectual Property

All Site content is the exclusive property of Quartz Epoxy Pro LLC and may not be copied, reproduced, or distributed without prior written consent.

12. Privacy Policy

Your use of the Site is governed by our Privacy Policy, which complies with Shopify’s data and payment processing requirements.

13. Third-Party Services

We use Shopify, payment processors, analytics tools, and advertising platforms. These services operate under their own terms and privacy policies.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

Any dispute shall be resolved exclusively in Maricopa County, Arizona.

Return and Refund Policy

Returns

  • Accepted within 7 days of delivery

  • Products must be unopened, unused, and in original packaging

  • Opened or mixed epoxy products cannot be returned

Refunds

  • Approved refunds issued within 5–7 business days

  • Shipping costs are non-refundable unless the product arrived defective

Damaged or Defective Products

  • Must be reported within 24 hours of delivery

  • Photos and order number required

Non-Returnable Items

  • Opened epoxy kits, hardeners, or additives

  • Custom-tinted or special-order materials

  • Clearance or discounted items

  • Tools & add-on accessories
